Good morning Adam,
Ms. Mobasser called my office several times yesterday, notwithstanding our directions and requests not to do so. A staff member told me she expressed a concern about her jewelry.
I have been instructed to inform you that my client is willing to release Ms. Mobasser’s jewelry, computers, and medications (currently being refrigerated) without the need for Ms. Mobasser to make any type of payment. However, any such release will have to go through your office in order to avoid any frivolous accusations of wrong doing. The remaining personal property will be handled in compliance with the applicable statutes.
Please let me know whether you are willing to facilitate and participate in this matter.
Sincerely,
Michael A. Brennan

Dear Michael:
I am forwarding this email to my client so that she can take the action.
I appreciate you not auctioning her medications and jewelry. I also ask that you not auction the credit cards or any other financial documents as that could lead to identity theft.
Regards,
Alan Goldberg

Here is the dilemma,
We will not allow her on the storage facility property due to the difficulty she presented to the sheriff’s at lockout. In other words, she created so many problems at the lockout, (including having to cut three locks off of the front door with an electric Sawzall and almost being pepper-sprayed) that we are scared to let her into the facility for fear that she will require the police to remove her.
Please let me know if you have any ideas.
Sincerely,
Michael A. Brennan

Dear Michael:
Thank you. Lets try to arrange this tomorrow, Monday.
Ms. Mobasser will go through my office for all communications with your office.
What time can she pick up those items?
Thank you.

Good morning Mr. Goldberg,
Apparently I misunderstood my client. Please disregard my prior email regarding returning Ms. Mobasser’s items, with the exception of her medications should she need them. Instead, my client has directed me to notify you that she intends to comply with the law regarding Ms. Mobasser’s belongings, with the slight exception that she will not auction Ms. Mobasser’s computers or jewelry.
You left me a message yesterday regarding Ms. Mobasser “taking over” the storage facility. In the absence of full payment of the invoice I forwarded to you within the statutory period, my client will auction the property. Ms. Mobasser may not simply take over the storage unit unless she makes payment in full.
Additionally, we are requesting copies of both writs filed previously by your client as well as any papers you end up filing on her behalf.
I will be in and out of the office today. Feel free to call.
Sincerely,
Michael A. Brennan

Alan,
In the absence of payment in full to my office via certified funds, your client will be permitted to neither take control of the property nor enter the unit.
We have already notified management at the facility. Only my client or I have authorization to enter the unit or release any property.
Please call me with a specific time at which payment will be delivered to my office.
Sincerely,
Michael A. Brennan

2/12/13
Dear Afsaneh:
This confirms my various conversations by phone this morning.
Payment for the storage facility is to be made to Mr. Brennan’s office. Please make the cashier’s check to “Brennan Law Firm Client Trust Account” only. You can drive it out there today and be into the storage facility this afternoon. Or, you can overnight the check to Mr. Brennan and be into the storage facility on or about Thursday (he is in trial all day tomorrow). If you need other options, please let me know. I have made arrangements with Mr. Brennan that, even though I am not your attorney of record, I will act as a go-between between you and his office to arrange for the storage facility to be in your name.

Dear Michael:
Just following up on our conversation this morning, I understand that a cashier's check was delivered to your office today for full payment of the storage charges. Yet, Afsaneh has not been given access and, apparently, won't be given access until Friday. Why is it taking so long? You asked for certified funds and received them and you said you would allow access immediately. I would like Afsaneh to have access tomorrow morning. Please advise.
Thank you,
Alan Goldberg

Allen,
Please inform your client that she has to call Roger to make arrangements to pick up her plants. I was unaware until this morning that the reason her plants were not taken to storage with the rest of her belongings is because the storage facility will not accept anything living, including animals, food, or plants, due to the requirement of care.
Your client’s plants are in the small rec room on the first floor of the building. She can contact Roger to set a time where she can pick them up, along with her medications that are currently being refrigerated.
Additionally, your client was found wandering the halls of the building at 8:30 the other night. Please inform her that if she is not there to visit a specific resident (rather than solicit signatures for her petition), my client intends to call the police for trespassing.
Let me know if you have any questions.
Sincerely,
Michael A. Brennan
