Subject: LETTER TO BRENNEN FROM YOU SEND IT TO LAWYER

Monday, April 2, 2012

The Brennan Law Firm67 E. Live Oak Ave. Arcadia, Ca. 91006

Attention: Michael E. Brennan
Reference: Your letter dated March 14, received after I filed a complaint with LAHD, and 3 day notice I received once work required by inspector Kaufman was completed.
Mr. Brennen

Your letter was three pages of dehumanizing intimidation, harassment, threats and untruths. The following are the facts: My one and only complaint to the LAHD was for the microwave, broken months ago, my many pleas to install one was ignored. You stated in your letter that I invented the ventilation problem. Fact is when I spoke with the lady at LAHD, my sole complaint was that your client refused to install a microwave for months on end. She asked me if the microwave was countertop or oven top. I said it is oven top. She rightly concluded if the microwave was broken, I also had no ventilation. As soon as I received manager’s notice stating that “you did not tell us it is ventilation you needed, had you told us that one, we would come fix it immediately“, I personally went to the manger and told him that there has been a mistake, that all I asked for was for the microwave to be finally installed. Then a notice was put on my door, stating that men will come to install the microwave at 8 am the next morning. I immediately called and left several messages for the manager who never picked up the phone, nor returned my messages. Finally, I texted him and told him the men are welcome to come anytime in the afternoon. Please do enlighten me as to how one fabricates a text, a copy of which I enclosed in my registered letter to your client. If an employee does not do his job right, I suggest you take it with him. I still have the aforementioned text on my iphone. I simply took a snapshot of the text and printed it. The next day beginning at 11 am, I called Mr. Hilmer several times and left a number of messages, stating that I am waiting for the repair personnel to come and install the microwave. You can verify my calls by asking Mr. Hilmer to provide you with his phone records. Again if the management’s employee does not do his job, I suggest she take it up with him.

Microwave & Ventilation System
While I did not personally check the ventilation system beneath the microwave nor observed any one do that, It would be a surprise to me if the ventilation system of a shut microwave worked. Upon receiving your letter, very distraught, I called inspector Kaufman. He looked at the order and explained to me that the clerk marked the ventilation system box as the two go hand in hand. You should not make up wild accusation, and assume that I will allow them to stand.

Unsealed counter-tops
Before we moved in, my mother showed the burnt areas on the counter-tops,
and asked that new counter tops be installed expressing her concerns with sanitation problems. Mr. Wolf refused. Your client has been in violation of LAHD sanitation codes for the past 16 years.

Damp Walls
Your client-serving claims in this letter are outright ridiculous. You have not even been careful making them up as you please, you shamelessly allowed your fantastical thinking defy undeniable truth and facts. Immediately prior to Monday morning when your client and her men came to fix the plaster, we had three days of constant heavy rains. (although rains are completely irrelevant ) Check the local weather service for those dates. I insist you must. There were three days of heavy storms and still on Monday morning when the manager, Roger Hilmer, kept touching the wall around the AC unit, trying to feel any wetness, they were all dry. I was present when the conversation between Mr. Hilmer and the man there to fix the plaster took place. Do please ask both if you have any interest in the truth, not making up stories to serve your clients whims. IT WAS ALL DRY.

For your information I had not watered the plants for the entire week since there was no need due to the intense, heavy rains. You may interview the contractor because that is exactly what I told him when he asked how often I water the plants. There was never any water seepage from outside. There were no cracks in the wall. The damage happens every year during the summer months when the air conditioner is on. The air condition is as old as the building, and has a condensation or other problem such as trapping the water inside.

When inspector Kaufman, while standing by the kitchen counter top, pointed his flash light to the plaster, I told him never mind that. At no point did I mention rain to Inspector Kaufman or felt the need to. I said only three words. ‘Never mind that ‘ He replied that he will report it. However, when I received your letter, I did call inspector Kaufman. He told me that I am allowed to water my plants on my balcony, that the balcony by law must have drainage. And wanted to know if your client thought plant watering was the problem, what about rain“, and that he knows better. He also said that the problem is a constructional problem. And now that the repairman has completely sealed the area between the wall and the AC container, YOUR POINT, EVEN IF YOU HAD ONE, IS COMPLETELY MUTE. However, I assure you when it gets hot and I turn on the AC again the plaster will be damaged. I explained this to Rosalie and asked that a non faulty unit be put instead. She, as per all my requests, declined.

As for your other fiction and exaggerations, I do not water my plants daily. I water biweekly. No pot ever fell from balcony. The only thing that fell was a very small amount of dirt in a paper container, from my hands when I lost my balance, as I was planting some cilantro seeds. This happened close to 11 at night, and had I not been a good conscientiousness tenant who immediately went to gather the dirt and clean up, and because it was dark, I asked a neighbor who was standing by the glass door to please turn on the light so I would leave no dirt on
the ground, no one would have known. As you and your client know, due to my health , I am insomniac. I never water the plants any earlier than midnight ,with one or two exception when it was very hot and they had all but died. I assure you, I have not and never will water plants before midnight.

There has been a history of management ignoring and refusing my pleas to fix problems. One time, I asked management for over a month to check into the leakage from the ceiling into my living room. Finally the ceiling and a flood of water came down on my dining area and table and chairs. I was drenched with water and lucky I moved in time not to get hurt. Even after I told Rosalie this had happened, she ignored me. Finally, I had no choice but to file a complaint with LAHD. Despite the danger to me, only after the management received the inspector’s letter, did Rosalie come to fix the ceiling and the leakage problem. And then she and her father repeatedly asked me to call LAHD at once and tell them not to come. I have kept all the pictures I took. And you may inquire as to the record from LAHD.

My letter to the management was a good faith effort after my pleas were ignored ad nauseam, and I received no reply to any of my communications from the management. I find it despicable that you call it self serving. I intend to comply and abide by all the laws and regulations. I have been in this apartment for over sixteen years. Speaking of health and safety of tenants, why have I not been afforded same? Yes Mr. Brennen, I hope that you and your client do stop with the games.
